“Our political goal is to establish a democratic and law-based state. In this regard, the Constitution of the Republic of Tajikistan, as the supreme document of the nation and the solid pillar of peace and unity, will remain our constant guide.”
— Founder of Peace and National Unity, Leader of the Nation, President of the Republic of Tajikistan, Honorable Emomali Rahmon.
One of the greatest achievements of the era of independence is the adoption of the Constitution of the Republic of Tajikistan.
Undoubtedly, the cause of this great historical event was the demand of the time, the progress of society, and the independence of our beloved country, Tajikistan.
As the fundamental and most important document of state and social life, the Constitution established a strong legal foundation for the country’s further development, ensuring the formation of a sovereign, legal, democratic, secular, and unitary state; the building of civil society; the development of new economic relations; the stable functioning of state institutions; and the guarantee of legality and public order.
This supreme legal document is indeed a source of pride and honor for every citizen of the country.
The Constitution laid the foundation for the nation’s legal system, state institutions, and governance structure; it established the basis for a democratic and law-based society and, for the first time in Tajik history, recognized the human being, his rights, and freedoms as the highest value.
With the adoption of the Constitution, the Tajik nation entered a qualitatively new stage of its historical development. In this new society, profound transformations began in various spheres of public and state life — economic, political, social, cultural, and judicial-legal.
Judicial power was recognized as an essential and indispensable branch of state authority, and the constitutional principle of judicial independence acquired a special place in the Constitution and current laws as one of the key requirements of a law-based state to ensure a competent, independent, and impartial judiciary.
Undoubtedly, this supreme legal document is both an achievement of independence and the main pillar strengthening it, and the day of its adoption is recorded in the annals of Tajik statehood in golden letters.
Over the past 29 years, we have succeeded in enshrining a series of fundamental principles of a democratic system, including the democratic foundations of state governance, the secular and social nature of the state, the sanctity of citizens’ rights and freedoms, the principle of political pluralism, the functioning of a professional parliament, the legal foundations of civil society, the inviolability of private property, the assurance of judicial justice, equality of all before the law, gender equality, and more — all firmly established in the Constitution of our country.
As defined by the Constitution, political life in Tajikistan proceeds on the basis of pluralism, and citizens may form public associations and political parties according to their political views and beliefs.
As the Russian scholar V. E. Chirkin noted:
“For a Constitution to function, it must take into account the real conditions of the state, the level of legal awareness of the population, the will of the people to strengthen democratic foundations, and to implement social and economic reforms, as well as other factors of public life.”
Thanks to the adoption of the Constitution, Tajikistan has become a full-fledged subject of international relations, and the Tajik people are now recognized as creative, peace-loving, and cultured. The Constitution has been able to express the interests of the Tajik nation and represent the Tajiks on the world stage.
Therefore, it is the duty of each of us to strengthen this priceless historical achievement, to safeguard the peace, national unity, freedom, stability, and territorial integrity of our beloved Tajikistan — achievements made possible by the distinguished and unique efforts of the Founder of Peace and National Unity, Leader of the Nation, President of the Republic of Tajikistan, Honorable Emomali Rahmon. We must cherish the values and norms of the Constitution, which connected Tajikistan with the civilized world community, and strive — on the basis of this document — to achieve our constructive national goals.
We express our hope and confidence that this sacred and destiny-shaping document will continue to shine as a bright beacon, illuminating the path of development of the independent Tajik state and its people for centuries to come.
