Scientific and Legal Analysis of the Law of the Republic of Tajikistan “On Amnesty”
On June 16, 2026, the President of the Republic of Tajikistan, Leader of the Nation, respected Emomali Rahmon, in connection with the 35th anniversary of the State Independence of the Republic of Tajikistan and exercising his constitutional authority, submitted the draft Law of the Republic of Tajikistan “On Amnesty” to the Majlisi namoyandagon of the Majlisi Oli of the Republic of Tajikistan, and after its adoption, signed the said law.
The adoption of the Law of the Republic of Tajikistan “On Amnesty” is one of the important manifestations of the state’s legal and humanitarian policy. Amnesty, as an important institution of constitutional and criminal law, represents not only a means of implementing the principles of humanism and social justice but also creates favorable conditions for the rehabilitation of persons who have committed crimes, restoration of their social ties, and their return to a full-fledged life in society.
From the perspective of legal science, amnesty is one of the forms of humanization of criminal policy, enabling the state, while ensuring judicial justice, to implement the principle of humanity. The essence of this legal act lies in granting certain categories of persons legal benefits and reliefs, providing them with an opportunity to reintegrate into a healthy social environment.
The Law on Amnesty also has political, social, and educational significance. On the one hand, it serves as clear evidence of the state’s attention to human dignity and respect for the rights and freedoms of citizens. On the other hand, this act contributes to strengthening social stability and reducing social tensions in penal institutions.
In modern legal theory, the effectiveness of punishment is assessed not only through the prism of restriction, but also through correction, education, and prevention of repeated offenses. In this regard, amnesty, as an instrument for improving criminal policy, can contribute to reducing the level of recidivism.
The implementation of such an initiative may contribute to reducing the workload of penal institutions, improving detention conditions, and ensuring a more effective focus of educational efforts on other convicted persons.
The Law provides additional benefits for women and minors, which demonstrates the implementation of the principles of international and national law concerning vulnerable groups of the population.
This approach is based on the fact that women and minors are under special protection of the state. With regard to minors, in particular, the principle of prioritizing education over punishment is applied, as the main goal is not merely punitive influence, but rather correction, personal development, and prevention of unlawful behavior.
The Law “On Amnesty” also applies to persons whose criminal cases are under consideration by judicial, inquiry, and investigative bodies. This provision demonstrates the broad scope of this legal act and allows the principle of humanism to be applied not only at the stage of execution of punishment but also at other stages of criminal proceedings.
Overall, the adoption of the Law of the Republic of Tajikistan “On Amnesty” on the eve of the celebration of the 35th anniversary of State Independence represents a reflection of the humanitarian policy of the President of the Republic of Tajikistan, respected Emomali Rahmon, and is of significant importance for strengthening the rule of law, social justice, and stability in society.
